El abogado general de la UE, Maciej Szpunar, ha emitido un informe en el que cuestiona el régimen de responsabilidad patrimonial del Estado español, derivado de la ley de 2015 sobre el régimen jurídico del sector público, lo que abre la puerta a reclamaciones millonarias de las liquidaciones de la plusvalía municipal, declarada nula por el Tribunal Constitucional, pero en cuya sentencia cierra la puerta a reclamar las liquidaciones ya emitidas y que no estén recurridas.
